Spearfishing Permit Application

  1. Submission of an application does not guarantee approval. Receipt of a spearfishing permit can take up to seven (7) business days. Please plan accordingly.
  2. This permit is good for 365 days after the date on the permit.
  3. City Code Sec. 58.068. - Possession of or shooting spearguns on city owned property permit required. (a) In this section, the term "speargun" means any type of device used for propelling a spear, or any other type projectile through water as a means of shooting or taking fish. (b) It is unlawful for any person to possess or shoot a speargun while in or upon city owned property without a program permit issued by the department. (Code 1970, § 16-9; Ord.   5. This permit does not supersede fishing requirements enforced by the State of Texas. This permit allows you to legally carry a speargun, as defined in the above listed ordinance, through a City of San Marcos park to access the river.
